These Terms of Service ("Terms") govern your access to and use of the website, store, content, products, and services (collectively, the "Services") offered by Trophy Terrain LLC ("Trophy Terrain," "we," "us," or "our"). By accessing or using the Services, or by placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
## 1. Eligibility
You must be at least the age of majority in your state of residence to use the Services or place an order. By using the Services, you represent that you meet this requirement and that the information you provide is accurate and complete.
## 2. Products, Orders, and Availability
We sell food plot seed blends, liquid food plot fertilizers, and related products and accessories. We reserve the right to limit quantities, refuse or cancel any order, discontinue any product, and correct errors in product descriptions, pricing, or availability at any time, even after an order has been submitted. If we cancel an order you have already paid for, we will issue a refund for that order.
Certain products, including liquid fertilizers, are regulated and may only be sold or shipped in states where they are registered. We may limit availability of products by location, and you are responsible for confirming that a product is legal for use in your area.
## 3. Pricing and Payment
All prices are shown in U.S. dollars and are subject to change without notice. You agree to pay all charges for your order, including applicable taxes and shipping fees, at the prices in effect when the order is placed. We use third-party payment processors, and by submitting payment information you authorize us and our processors to charge your selected payment method.
## 4. Shipping, Returns, and Refunds
Shipping timeframes and costs are described at checkout and in our Shipping Policy. Title and risk of loss pass to you upon our delivery of the products to the carrier. Returns and refunds are governed by our Returns and Refunds Policy, which is incorporated into these Terms by reference.
## 5. Product Use and Disclaimer of Results
Our products are plant fertilizers and seed intended for use on food plots. You are responsible for reading and following all product label directions, application rates, and safety instructions, and for complying with all applicable federal, state, and local laws governing the purchase, use, application, and storage of seed and fertilizer.
Food plot results depend on many factors outside our control, including soil condition, weather, moisture, timing, application, and wildlife activity. We do not guarantee any specific germination, stand, growth, tonnage, forage outcome, or wildlife result. Nothing in the Services or on any product should be understood as a promise of a particular result.
## 6. Acceptable Use
You agree not to use the Services for any unlawful or prohibited purpose, to interfere with or disrupt the Services, to attempt to gain unauthorized access to any part of the Services, or to use the Services in any way that could damage, disable, or impair them or infringe the rights of others.
## 7. User Content and Reviews
If you submit reviews, photos, comments, or other content through the Services, you grant Trophy Terrain a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, display, and distribute that content in connection with our business and marketing. You represent that you own or have the rights to the content you submit and that it does not violate the rights of any third party. We may remove any content at our discretion.
## 8. Intellectual Property
The Services and all content, including the Trophy Terrain name and logo, product names such as Buck 10, Even 7, Keeper, Rack Builder Ca-B, Trophy Trio, Triple Threat, and Monarch Mix, and all text, graphics, and images, are owned by or licensed to Trophy Terrain LLC and are protected by trademark, copyright, and other laws. You may not copy, reproduce, or use any of this content without our prior written permission.
## 9. Third-Party Links
The Services may contain links to third-party websites or resources. We are not responsible for the content, products, or practices of any third-party sites, and your use of them is at your own risk and subject to their terms.
## 10. Disclaimer of Warranties
The Services and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
## 11. Limitation of Liability
To the fullest extent permitted by law, Trophy Terrain LLC and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or plot results, arising out of or related to your use of the Services or any product. Our total liability for any claim arising out of or related to the Services or a product will not exceed the amount you paid for the product giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

You agree to indemnify and hold harmless Trophy Terrain LLC and its owners, employees, and affiliates from any claims, damages, losses, and expenses, including reasonable legal fees, arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.

These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Utah, unless otherwise required by applicable law.
